PAPERLESS ORDER denying 32 Motion for Leave to Take Depositions of Witnesses Outside of the Country as to Jianxiang Shi (1). In his Motion, Defendant seeks to depose two foreign witnesses, Qian Hou and Mindy Wang, by video. The Motion is denied because the Court does not find the proffered testimony to be material. While the Court must not weigh evidence in making this determination, it is undisputed that neither Ms. Hou nor Ms. Wang is listed as a preparer on Defendant's U.S. Visa applications at issue. Even so, the Court does not find exceptional circumstances, or even good cause, to take their depositions over Zoom as requested. And Defendant has not established exceptional circumstances justifying the taking of their depositions in Singapore and Canada at this late stage of the case. The substance of Ms. Hou and Ms. Wang's proffered testimony would have been known to Defendant at the time of his October 28, 2021 arrest. However, the instant motion was filed six months later. The case is now specially set for trial on August 2, 2022. While a trial delay is not necessarily a dispositive factor, Defendant has not justified his lack of diligence here.
